OBJETO DA PLATAFORMA<\/span><\/h2>\n<p>A AZCLAN \u00e9 uma <strong>plataforma digital de intermedia\u00e7\u00e3o social<\/strong>, de natureza h\u00edbrida, destinada a:<\/p>\n<ul>\n<li>\n<p>Intera\u00e7\u00f5es sociais e comunit\u00e1rias;<\/p>\n<\/li>\n<li>\n<p>Relacionamentos afetivos, rom\u00e2nticos e pessoais;<\/p>\n<\/li>\n<li>\n<p>Conex\u00f5es profissionais;<\/p>\n<\/li>\n<li>\n<p>Compartilhamento de conte\u00fados gerados por usu\u00e1rios;<\/p>\n<\/li>\n<li>\n<p>Cria\u00e7\u00e3o, publica\u00e7\u00e3o e aceite de <strong>cl\u00e1usulas e acordos de relacionamento<\/strong> entre usu\u00e1rios.<\/p>\n<\/li>\n<\/ul>\n<p>A AZCLAN <strong>n\u00e3o participa, n\u00e3o valida e n\u00e3o interfere<\/strong> nos acordos firmados entre usu\u00e1rios, limitando-se a disponibilizar o ambiente tecnol\u00f3gico.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">2. ELEGIBILIDADE E ACESSO<\/span><\/h2>\n<p>2.1. O uso da Plataforma \u00e9 exclusivo para <strong>maiores de 18 (dezoito) anos<\/strong>.<br \/>2.2. Ao se cadastrar, o usu\u00e1rio declara possuir plena capacidade civil.<br \/>2.3. \u00c9 vedado o uso por usu\u00e1rios previamente suspensos ou banidos.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">3. CADASTRO, PERFIL E CRUZAMENTO DE INFORMA\u00c7\u00d5ES<\/span><\/h2>\n<p>3.1. Dados obrigat\u00f3rios para cadastro:<\/p>\n<ul>\n<li>\n<p>Nome;<\/p>\n<\/li>\n<li>\n<p>Endere\u00e7o de e-mail;<\/p>\n<\/li>\n<li>\n<p>Data de nascimento.<\/p>\n<\/li>\n<\/ul>\n<p>3.2. Para fins de <strong>personaliza\u00e7\u00e3o, afinidade e preven\u00e7\u00e3o de conflitos<\/strong>, a Plataforma poder\u00e1 solicitar dados adicionais, como:<\/p>\n<ul>\n<li>\n<p>Filosofia religiosa, espiritual ou aus\u00eancia de cren\u00e7a;<\/p>\n<\/li>\n<li>\n<p>Profiss\u00e3o ou ocupa\u00e7\u00e3o;<\/p>\n<\/li>\n<li>\n<p>Estado, cidade e bairro.<\/p>\n<\/li>\n<\/ul>\n<p>3.3. Essas informa\u00e7\u00f5es poder\u00e3o ser utilizadas para <strong>filtros de usu\u00e1rios<\/strong>, respeitadas as configura\u00e7\u00f5es de privacidade escolhidas pelo pr\u00f3prio usu\u00e1rio.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">4. FILOSOFIAS, RELIGI\u00d5ES, LINHAS ESPIRITUAIS E FILTROS<\/span><\/h2>\n<p>4.1. A AZCLAN respeita a pluralidade de filosofias, religi\u00f5es, linhas espirituais e vis\u00f5es de mundo.<\/p>\n<p>4.2. A Plataforma disponibiliza <strong>filtros por filosofia, religi\u00e3o ou linha espiritual<\/strong> com o objetivo de:<\/p>\n<ul>\n<li>\n<p>Promover conviv\u00eancia respeitosa;<\/p>\n<\/li>\n<li>\n<p>Evitar conflitos ideol\u00f3gicos;<\/p>\n<\/li>\n<li>\n<p>Facilitar conex\u00f5es por afinidade.<\/p>\n<\/li>\n<\/ul>\n<p>4.3. \u00c9 proibida qualquer forma de intoler\u00e2ncia, discurso de \u00f3dio ou discrimina\u00e7\u00e3o.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">5. CL\u00c1USULAS E ACORDOS DE RELACIONAMENTO ENTRE USU\u00c1RIOS<\/span><\/h2>\n<p>5.1. A Plataforma disponibiliza funcionalidades para que os usu\u00e1rios <strong>criem, publiquem e compartilhem cl\u00e1usulas e acordos de relacionamento<\/strong>, incluindo, mas n\u00e3o se limitando \u00e0s seguintes categorias:<\/p>\n<ul>\n<li>\n<p>Amizade;<\/p>\n<\/li>\n<li>\n<p>Namoro;<\/p>\n<\/li>\n<li>\n<p>Uni\u00e3o afetiva;<\/p>\n<\/li>\n<li>\n<p>Rela\u00e7\u00f5es profissionais.<\/p>\n<\/li>\n<\/ul>\n<p>5.2. Tais cl\u00e1usulas e acordos t\u00eam como finalidade:<\/p>\n<ul>\n<li>\n<p>Estabelecer expectativas, limites e compromissos entre usu\u00e1rios;<\/p>\n<\/li>\n<li>\n<p>Facilitar rela\u00e7\u00f5es baseadas em transpar\u00eancia, boa-f\u00e9 e respeito m\u00fatuo.<\/p>\n<\/li>\n<\/ul>\n<p>5.3. Os acordos s\u00e3o <strong>integralmente criados pelos usu\u00e1rios<\/strong>, que assumem total responsabilidade por seu conte\u00fado, interpreta\u00e7\u00e3o, validade e cumprimento.<\/p>\n<p>5.4. Ao aceitar um acordo publicado por outro usu\u00e1rio, o usu\u00e1rio reconhece que:<\/p>\n<ul>\n<li>\n<p>O acordo possui <strong>natureza privada<\/strong>, firmada exclusivamente entre as partes;<\/p>\n<\/li>\n<li>\n<p>A AZCLAN <strong>n\u00e3o \u00e9 parte<\/strong>, n\u00e3o atua como testemunha, mediadora ou garantidora;<\/p>\n<\/li>\n<li>\n<p>A Plataforma <strong>n\u00e3o assegura validade jur\u00eddica<\/strong>, exigibilidade legal ou cumprimento do acordo.<\/p>\n<\/li>\n<\/ul>\n<p>5.5. A AZCLAN <strong>n\u00e3o se responsabiliza<\/strong> por:<\/p>\n<ul>\n<li>\n<p>Descumprimento de acordos entre usu\u00e1rios;<\/p>\n<\/li>\n<li>\n<p>Danos morais, emocionais, financeiros ou de qualquer natureza decorrentes desses acordos;<\/p>\n<\/li>\n<li>\n<p>Conflitos oriundos da interpreta\u00e7\u00e3o ou execu\u00e7\u00e3o das cl\u00e1usulas pactuadas.<\/p>\n<\/li>\n<\/ul>\n<p>5.6. \u00c9 vedada a cria\u00e7\u00e3o ou publica\u00e7\u00e3o de cl\u00e1usulas que:<\/p>\n<ul>\n<li>\n<p>Violem a legisla\u00e7\u00e3o vigente;<\/p>\n<\/li>\n<li>\n<p>Incentivem pr\u00e1ticas il\u00edcitas, abusivas ou discriminat\u00f3rias;<\/p>\n<\/li>\n<li>\n<p>Restringem direitos fundamentais;<\/p>\n<\/li>\n<li>\n<p>Imponham obriga\u00e7\u00f5es ilegais ou inexequ\u00edveis.<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"western\"><span style=\"font-size: large;\">6. CONTE\u00daDO GERADO PELO USU\u00c1RIO (UGC)<\/span><\/h2>\n<p>6.1. Todo conte\u00fado publicado, incluindo acordos e cl\u00e1usulas, \u00e9 de responsabilidade exclusiva do usu\u00e1rio.<\/p>\n<p>6.2. Ao publicar conte\u00fado, o usu\u00e1rio concede \u00e0 AZCLAN licen\u00e7a gratuita, n\u00e3o exclusiva e mundial para exibi\u00e7\u00e3o interna.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">7. MODERA\u00c7\u00c3O E MEDIDAS DISCIPLINARES<\/span><\/h2>\n<p>7.1. A AZCLAN poder\u00e1 remover conte\u00fados ou restringir contas que violem este Termo, especialmente em casos de:<\/p>\n<ul>\n<li>\n<p>Ass\u00e9dio;<\/p>\n<\/li>\n<li>\n<p>Intoler\u00e2ncia;<\/p>\n<\/li>\n<li>\n<p>Seja il\u00edcito, ofensivo, abusivo ou discriminat\u00f3rio;<\/p>\n<\/li>\n<li>\n<p>Conte\u00fado ilegal ou abusivo;<\/p>\n<\/li>\n<li>\n<p>Configure ass\u00e9dio, amea\u00e7a ou persegui\u00e7\u00e3o;<\/p>\n<\/li>\n<li>\n<p>Viole direitos de terceiros;<\/p>\n<\/li>\n<li>\n<p>Promova \u00f3dio, viol\u00eancia ou atividades ilegais;<\/p>\n<\/li>\n<li>\n<p>Uso indevido das cl\u00e1usulas de relacionamento.<\/p>\n<\/li>\n<li>\n<p>Envolva menores de idade, direta ou indiretamente.<\/p>\n<\/li>\n<\/ul>\n<p>7.2. As medidas podem incluir advert\u00eancia, suspens\u00e3o ou exclus\u00e3o definitiva da conta.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">8. RELACIONAMENTOS E INTERA\u00c7\u00d5ES AFETIVAS<\/span><\/h2>\n<p>8.1. A AZCLAN <strong>n\u00e3o garante compatibilidade, veracidade, boa-f\u00e9 ou conduta \u00e9tica<\/strong> dos usu\u00e1rios.<\/p>\n<p>8.2. Qualquer relacionamento, acordo ou intera\u00e7\u00e3o afetiva estabelecida entre usu\u00e1rios ocorre <strong>por conta e risco exclusivo das partes envolvidas<\/strong>.<\/p>\n<p>8.3. A Plataforma <strong>n\u00e3o se responsabiliza<\/strong> por danos emocionais, morais, financeiros ou de qualquer natureza decorrentes de rela\u00e7\u00f5es entre usu\u00e1rios.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">9. MODERA\u00c7\u00c3O E MEDIDAS DISCIPLINARES<\/span><\/h2>\n<p>9.1. A AZCLAN poder\u00e1, <strong>a seu exclusivo crit\u00e9rio<\/strong>, moderar, remover conte\u00fados ou restringir contas que violem este Termo ou a legisla\u00e7\u00e3o vigente.<\/p>\n<p>9.2. As medidas podem incluir:<\/p>\n<ul>\n<li>\n<p>Advert\u00eancia;<\/p>\n<\/li>\n<li>\n<p>Suspens\u00e3o tempor\u00e1ria;<\/p>\n<\/li>\n<li>\n<p>Exclus\u00e3o definitiva da conta, sem necessidade de aviso pr\u00e9vio.<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"western\"><span style=\"font-size: large;\">10. LIMITA\u00c7\u00c3O DE RESPONSABILIDADE<\/span><\/h2>\n<p>A AZCLAN n\u00e3o se responsabiliza por:<\/p>\n<ul>\n<li>\n<p>Conte\u00fados e acordos criados por usu\u00e1rios;<\/p>\n<\/li>\n<li>\n<p>Rela\u00e7\u00f5es pessoais, afetivas ou profissionais entre usu\u00e1rios;<\/p>\n<\/li>\n<li>\n<p>Conflitos decorrentes de acordos privados;<\/p>\n<\/li>\n<li>\n<p>Danos decorrentes do uso da Plataforma.<\/p>\n<\/li>\n<li>\n<p>Interrup\u00e7\u00f5es t\u00e9cnicas ou falhas do sistema;<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"western\"><span style=\"font-size: large;\">11. <\/span><span style=\"font-size: large;\">Compatibilidade de Vis\u00e3o de Mundo (<\/span><span style=\"font-size: large;\">EXTRA<\/span><span style=\"font-size: large;\">)<\/span><\/h2>\n<h3 class=\"western\">11.1. Finalidade<\/h3>\n<p>A coleta e o tratamento das informa\u00e7\u00f5es relacionadas \u00e0 vis\u00e3o de mundo, espiritualidade ou posicionamento filos\u00f3fico do usu\u00e1rio t\u00eam como <strong>finalidade exclusiva<\/strong> promover compatibilidade entre perfis, reduzir conflitos interpessoais e preservar a experi\u00eancia segura e respeitosa dentro do ambiente de relacionamentos da plataforma.<\/p>\n<h3 class=\"western\">11.2. Natureza das Informa\u00e7\u00f5es<\/h3>\n<p>As informa\u00e7\u00f5es fornecidas neste contexto:<\/p>\n<ul>\n<li>\n<p>n\u00e3o s\u00e3o utilizadas para fins de discrimina\u00e7\u00e3o;<\/p>\n<\/li>\n<li>\n<p>n\u00e3o implicam ju\u00edzo de valor, classifica\u00e7\u00e3o moral ou exclus\u00e3o social;<\/p>\n<\/li>\n<li>\n<p>n\u00e3o s\u00e3o compartilhadas com terceiros;<\/p>\n<\/li>\n<li>\n<p>s\u00e3o utilizadas apenas para <strong>l\u00f3gica interna de compatibilidade e filtragem volunt\u00e1ria<\/strong> entre usu\u00e1rios.<\/p>\n<\/li>\n<\/ul>\n<h3 class=\"western\">11.3. Consentimento Livre e Informado<\/h3>\n<p>Ao aderir \u00e0s cl\u00e1usulas de relacionamento e utilizar os recursos de intera\u00e7\u00e3o afetiva da plataforma, o usu\u00e1rio declara que:<\/p>\n<ul>\n<li>\n<p>fornece tais informa\u00e7\u00f5es de forma <strong>livre, consciente e volunt\u00e1ria<\/strong>;<\/p>\n<\/li>\n<li>\n<p>compreende que determinados perfis podem adotar filtros de compatibilidade baseados em vis\u00e3o de mundo;<\/p>\n<\/li>\n<li>\n<p>reconhece que a indisponibilidade de intera\u00e7\u00e3o decorrente desses filtros <strong>n\u00e3o configura penalidade, bloqueio de conta ou discrimina\u00e7\u00e3o<\/strong>, mas simples incompatibilidade de proposta relacional.<\/p>\n<\/li>\n<\/ul>\n<h3 class=\"western\">11.4. Limita\u00e7\u00e3o de Uso<\/h3>\n<p>\u00c9 expressamente vedado o uso da plataforma para:<\/p>\n<ul>\n<li>\n<p>tentativa de convers\u00e3o religiosa ou espiritual;<\/p>\n<\/li>\n<li>\n<p>imposi\u00e7\u00e3o de cren\u00e7as, dogmas ou doutrinas;<\/p>\n<\/li>\n<li>\n<p>constrangimento, ass\u00e9dio moral ou julgamento baseado em f\u00e9 ou aus\u00eancia dela.<\/p>\n<\/li>\n<\/ul>\n<p>O descumprimento poder\u00e1 resultar em restri\u00e7\u00e3o ou suspens\u00e3o de funcionalidades, conforme os Termos Gerais da Plataforma.<\/p>\n<h3 class=\"western\">11.5. Base Legal (Lei n\u00ba 13.709\/2018 \u2013 LGPD)<\/h3>\n<p>O tratamento dos dados mencionados nesta cl\u00e1usula fundamenta-se:<\/p>\n<ul>\n<li>\n<p>no <strong>consentimento do titular<\/strong> (art. 7\u00ba, I);<\/p>\n<\/li>\n<li>\n<p>na <strong>execu\u00e7\u00e3o de contrato ou procedimentos preliminares<\/strong> relacionados \u00e0 experi\u00eancia oferecida pela plataforma (art. 7\u00ba, V);<\/p>\n<\/li>\n<li>\n<p>e na <strong>prote\u00e7\u00e3o do leg\u00edtimo interesse<\/strong> do controlador em manter um ambiente seguro, coerente e funcional (art. 7\u00ba, IX), observados os direitos e liberdades fundamentais do titular.<\/p>\n<\/li>\n<\/ul>\n<h3 class=\"western\">11.6. Direitos do Titular<\/h3>\n<p>O usu\u00e1rio poder\u00e1, a qualquer momento:<\/p>\n<ul>\n<li>\n<p>revisar ou alterar as informa\u00e7\u00f5es fornecidas;<\/p>\n<\/li>\n<li>\n<p>solicitar a limita\u00e7\u00e3o ou exclus\u00e3o desses dados;<\/p>\n<\/li>\n<li>\n<p>revogar o consentimento, ciente de que isso poder\u00e1 impactar o uso das funcionalidades de relacionamento.<\/p>\n<\/li>\n<\/ul>\n<h2 class=\"western\"><span style=\"font-size: large;\">12. PROPRIEDADE INTELECTUAL<\/span><\/h2>\n<p>12.1. Todos os direitos sobre a marca, layout, sistemas, c\u00f3digos e identidade visual da Plataforma pertencem exclusivamente \u00e0 AZCLAN.<\/p>\n<p>12.2. \u00c9 vedada a reprodu\u00e7\u00e3o, modifica\u00e7\u00e3o ou explora\u00e7\u00e3o comercial sem autoriza\u00e7\u00e3o expressa.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">13. ACEITE ELETR\u00d4NICO E REGISTRO<\/span><\/h2>\n<p>13.1. O aceite ocorre por <strong>checkbox obrigat\u00f3rio no cadastro<\/strong>.<br \/>13.2. S\u00e3o registrados:<\/p>\n<ul>\n<li>\n<p>Data e hora do aceite;<\/p>\n<\/li>\n<li>\n<p>Endere\u00e7o IP do usu\u00e1rio;<\/p>\n<\/li>\n<li>\n<p>Vers\u00e3o do Termo aceita.<\/p>\n<p>Esse registro constitui prova v\u00e1lida para fins legais.<br \/><br \/><br \/><\/p>\n<\/li>\n<\/ul>\n<h2 class=\"western\"><span style=\"font-size: large;\">14. ENCERRAMENTO DA CONTA<\/span><\/h2>\n<p>14.1. O usu\u00e1rio poder\u00e1 solicitar o encerramento da conta a qualquer momento, observadas as obriga\u00e7\u00f5es legais.<br \/>14.2. A AZCLAN poder\u00e1 manter dados m\u00ednimos conforme obriga\u00e7\u00f5es legais e regulat\u00f3rias.<\/p>\n<p><br \/><br \/><\/p>\n<p><b>15. USO DO SERVI\u00c7O DE MENSAGENS PRIVADAS, RETEN\u00c7\u00c3O E EXCLUS\u00c3O DE CONTE\u00daDO<\/b><\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">1. Do objeto e da natureza do servi\u00e7o<\/span><\/h2>\n<p>1.1. O servi\u00e7o de mensagens privadas disponibilizado pela plataforma constitui funcionalidade acess\u00f3ria, de car\u00e1ter <strong>instrumental, transit\u00f3rio e n\u00e3o permanente<\/strong>, destinada exclusivamente \u00e0 comunica\u00e7\u00e3o direta entre usu\u00e1rios cadastrados, no \u00e2mbito das finalidades sociais e comunit\u00e1rias da plataforma.<\/p>\n<p>1.2. O referido servi\u00e7o <strong>n\u00e3o se caracteriza como meio de arquivamento, cust\u00f3dia, preserva\u00e7\u00e3o ou guarda de dados<\/strong>, documentos, informa\u00e7\u00f5es ou registros de qualquer natureza, n\u00e3o assumindo a plataforma obriga\u00e7\u00e3o de conserva\u00e7\u00e3o continuada de seu conte\u00fado.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">2. Do prazo de reten\u00e7\u00e3o e da exclus\u00e3o autom\u00e1tica<\/span><\/h2>\n<p>2.1. As mensagens privadas, bem como quaisquer conte\u00fados, registros t\u00e9cnicos e metadados a elas associados, ser\u00e3o armazenados pelo prazo m\u00e1ximo e improrrog\u00e1vel de <strong>60 (sessenta) dias<\/strong>, contados a partir da data de seu efetivo envio.<\/p>\n<p>2.2. Findo o prazo previsto no item 2.1, o conte\u00fado ser\u00e1 <strong>automaticamente, irrevogavelmente e definitivamente exclu\u00eddo<\/strong>, sem necessidade de notifica\u00e7\u00e3o individual ao usu\u00e1rio, abrangendo, inclusive, eventuais c\u00f3pias de seguran\u00e7a mantidas para fins operacionais.<\/p>\n<p>2.3. A exclus\u00e3o prevista nesta cl\u00e1usula <strong>n\u00e3o comporta recupera\u00e7\u00e3o, restaura\u00e7\u00e3o ou acesso posterior<\/strong>, sob qualquer hip\u00f3tese.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\"><b>3. Da base legal e dos princ\u00edpios aplic\u00e1veis<\/b><\/span><\/h2>\n<p>3.1. O tratamento de dados pessoais decorrente da utiliza\u00e7\u00e3o do servi\u00e7o de mensagens privadas fundamenta-se nas bases legais previstas nos incisos <strong>V<\/strong> (execu\u00e7\u00e3o de contrato) e <strong>IX<\/strong> (leg\u00edtimo interesse do controlador) do art. 7\u00ba da Lei n\u00ba 13.709\/2018 (Lei Geral de Prote\u00e7\u00e3o de Dados \u2013 LGPD).<\/p>\n<p>3.2. O acesso ao conte\u00fado somente poder\u00e1 ocorrer de forma <strong>excepcional<\/strong>, quando:<br \/>a) exigido por obriga\u00e7\u00e3o legal ou regulat\u00f3ria;<br \/>b) determinado por ordem judicial v\u00e1lida;<br \/>c) necess\u00e1rio para apura\u00e7\u00e3o de infra\u00e7\u00f5es aos Termos de Uso ou \u00e0 legisla\u00e7\u00e3o aplic\u00e1vel, observados os limites legais.<\/p>\n<h2 class=\"western\"><span style=\"font-size: large;\">6.
